Illegal or unauthorized use of the program is prohibited.
Affiliate Program
Unique Affiliate Code provided upon sign-up.
Referral fees apply only to sales through correctly implemented Special Links.
Affiliate links should direct to the promoted product page.
Customer Definition
Customers referred through the program are ThemeMarts customers.
ThemeMarts sets prices and policies, which are subject to change.
Affiliate Responsibilities
Maintain and operate your site in compliance with third-party agreements and applicable laws.
Ensure posted materials are accurate and lawful.
Provide a clear privacy policy if collecting visitor data.
Compliance with Laws
Participants must comply with all applicable local, state, and federal laws, including anti-spam laws.
Term and Termination
The agreement begins upon application approval and may be terminated by either party at any time.
Upon termination, all links, trademarks, and related materials must be removed.
Outstanding earnings above $20 will be paid upon termination.
Limitations of Liability
ThemeMarts is not liable for indirect, special, or consequential damages.
Liability is limited to referral fees paid under the agreement.
Arbitration
Disputes will be resolved through confidential arbitration per the American Arbitration Association.
ThemeMarts may seek relief in court for intellectual property violations.
Miscellaneous
The agreement is governed by U.S. laws.
No rights or provisions are waived without written consent.
The Terms of Service constitute the entire agreement, superseding prior versions.
